Terms and Conditions of Sale

1. Subject matter and scope

These General Terms and Conditions of Sale (“Terms”) govern the sale of products marketed through the S’Isula website (the “Site”) and apply to all orders placed by users (the “Customer”).
Placing an order implies full acceptance of these Terms.

The Terms apply both to purchases made by Consumers (individuals purchasing for purposes unrelated to business or professional activity) and to Professional Customers (VAT holders), unless otherwise specified.

3. Products and pre-contractual information

The essential characteristics of the products (for example: ceramics, textiles, sponges, gift boxes, typical products, and seasonal items) are described in the relative product sheets.

Images and colors displayed may vary depending on the device used and, for handcrafted products, slight differences may exist between pieces of the same type.

In case of obvious discrepancies or doubts about measurements/materials/variants, the Customer can contact support before purchasing.

4. Product availability

The availability indicated on the Site is updated periodically. In exceptional cases, items may become unavailable after an order is placed.
In such cases, the Customer will be contacted promptly to agree on a solution (replacement, waiting, full or partial refund).

5. Prices, currency, and taxes

All prices are expressed in Euros. Unless otherwise indicated, prices are inclusive of VAT (if applicable).
Any additional costs (e.g., shipping, cash on delivery, or accessory services) are clearly indicated before order confirmation.

The Seller reserves the right to change prices at any time; the prices applied will be those valid at the time the order is placed.

6. Registration and data accuracy

The Customer can purchase by registering an account or, if provided for, as a guest.
The Customer is responsible for the truthfulness and correctness of the data entered (address, contact details, email). Any errors may cause delays or non-delivery.

7. Purchase procedure and conclusion of the contract

The order is placed through the Site’s checkout.

  1. The Customer selects the products and submits the order.
  2. The system sends an order receipt email.
  3. The sales contract is considered concluded with the confirmation of fulfillment/shipping or with another explicit confirmation from the Seller.

The Seller may refuse or cancel an order, for example, in the event of:

  • incomplete or unverifiable data;
  • unavailability of the product;
  • suspected fraudulent use;
  • obvious errors in price or description.

8. Payment methods

The Customer can use the payment methods made available at checkout, including:

  • Credit/debit card
  • PayPal
  • Bank transfer
  • Cash on delivery (if available for the selected destination)

In the case of electronic payment, payment data is managed by the provider and is not stored by the Seller.

For bank transfers, the order can be fulfilled after the credit is received (unless otherwise indicated).

9. Sale of alcohol

Some products for sale on the Site may contain alcohol (for example: mirto and other liqueurs).
The purchase of alcoholic products is reserved for adults. By submitting the order, the Customer declares that they are of the age required by current legislation. The Seller reserves the right to carry out checks or request verification during delivery, where provided for.

10. Customizations and made-to-measure products

The Site may offer personalized products (e.g., customizable baskets, gift compositions, items personalized upon request).
For such products:

  • customization specifications are defined during the ordering phase and/or through contact with the Customer;
  • preparation times may vary based on the complexity of the request;
  • any changes requested after confirmation might not always be possible or could involve additional costs/time.

11. Shipping and delivery

11.1 Delivery areas

Shipments are made within Italy.
The Site and the logistics organization are set up to also handle shipments throughout Europe, which may be made available based on destinations, couriers, and operational conditions.

11.2 Delivery times

Delivery times depend on the destination, period, and product availability. During peak seasons (e.g., Christmas, Easter, promotions), longer times may occur.
The times indicated on the Site are indicative and do not constitute an essential deadline.

11.3 Shipping costs

Shipping costs are calculated and shown before order confirmation. They may vary based on weight/volume, destination, and any active promotions.

11.4 Verification upon delivery

Upon delivery, the Customer is invited to check the integrity of the packaging and the correspondence of the packages. In case of a visibly damaged or tampered package, it is recommended to:

  • accept with reservation (if possible) or refuse the package,
  • document with photos,
  • contact support promptly.

12. Right of withdrawal

12.1 Terms

The Consumer Customer can exercise the right of withdrawal within 14 days of delivery, without obligation to provide a reason, except for exceptions provided by law.

12.2 Procedures

To exercise the withdrawal, the Customer must send a clear communication (email or other indicated channel) specifying:

  • order number,
  • products subject to withdrawal,
  • Customer data.

12.3 Return and refund

The Customer must return the products within 14 days of the withdrawal communication, properly packaged.
The refund will be made using the same payment method (where possible) within the legal terms, except in cases where it is necessary to verify the condition of the returned goods.

13. Exceptions

Some product categories may be subject to limitations on the right of withdrawal according to regulations (for example, personalized goods or food products under certain conditions).

Without prejudice to the application of mandatory rules, S’Isula manages requests with an approach oriented towards maximum cooperation with the Customer, evaluating the most appropriate solution case by case (replacement, refund, voucher, etc.), compatibly with the type of product and the state of the goods.

14. Legal guarantee and non-conforming products

For Consumers, the legal guarantee of conformity applies according to current legislation.
In case of a defective, damaged, or non-conforming product, the Customer must contact support indicating:

  • order number,
  • description of the problem,
  • photos of the product and packaging (if useful).

The Seller will evaluate the most suitable solution (repair, replacement, refund), according to law and availability.

15. Order cancellation

The Customer can request the cancellation of the order before fulfillment by contacting support promptly.
If the order has already been shipped, the request will be managed according to the withdrawal or after-sales support procedures.

16. Promotions, coupons, and discounts

Any discounts or promotional codes are valid under the conditions indicated at the time of communication and may:

  • have a limited duration;
  • not be combinable;
  • exclude certain categories/products.

In case of improper use or anomalies, the Seller may cancel the order.

17. Intellectual property

Trademarks, logos, images, texts, and Site content are protected. Total or partial reproduction without authorization is prohibited.

18. Processing of personal data

The Customer’s personal data is processed according to the Site’s Privacy Policy and applicable legislation (GDPR).

19. Force majeure

The Seller is not responsible for delays or non-performance due to force majeure or events beyond its control (strikes, logistical blocks, disasters, service interruptions, etc.). In such cases, the Customer will be informed and compatible solutions will be proposed.

20. Applicable law and jurisdiction

These Terms are governed by Italian law.

If the Customer is a Consumer, the court of the place of residence or domicile of the Customer, if located in Italy, has jurisdiction for disputes.
For non-Consumer Customers, the Seller’s court has jurisdiction, unless otherwise provided by mandatory law.
The European ODR platform is also available for the online resolution of disputes between consumers and professionals.

21. Changes to the Terms

The Seller may update these Terms at any time. Changes will be effective from their publication on the Site and will apply to orders placed subsequently.
